Hit And Run Lawyers and Accident Laws

I usually thought that what’s the toughest of all fraternities, & I always came upon one conclusion that’s it’s the law fraternity, where you have to prove to a bunch of people called the jury the facts that you have just heard from your client & have not experienced them first hand, either its true or false you’re never 100% sure, but once you have vowed to take up the case & uphold his dignity right or wrong doesn’t matter & his argument becomes yours.

All lawyers have their distinctive touch & all have their own way to tackle clients depending upon their conviction, they all also have their own benchmark according to their worth & past achievements, but according to my analyses the breed that is called hit and run lawyers are the most witty & shrewd of them all, as they take up the responsibility & claim to save a guy who has just killed or injured a human being or damaged a public or private property with his car & then even more has sped away irrespective of what has happened to the poor soul. But then it’s also the other way round, that same lawyer may also take up the case of the victim & get him justice.

If we look at the latter this type of lawyer needs a lot of experience & expertise as saving a person from the shackles in such cases isn’t easy , the most successful of lawyers are the ones who can create an argument & confuse the judge in a very simple hit & run case, as if we see there is nothing confusing about this , a person has hit another person with a car & ran away, even if he didn’t succumb to his injuries its just human to stop & take him to hospital, but he ran away & that’s a crime in itself , so why the fuss punish this guy!
But no its not that easy when our actors come in , he will make the scene fuzzy for the thinker judge, he will be sprayed with new logics such as, the brakes failed! He was distracted by the police constable at the square! He suddenly came in front of me! But why didn’t you stop!!! Well I was scared it’s a simple human emotion, anyone can be scared , so he has created a point of thought that he didn’t murder him as it was not done intentionally & was out of accident, so half the case has been won, now the running away part is left, well the judge can show some mercy & let him off, but Mr. lawyer will probably go for a compensation amount & settle the dispute between the affected.

But if the same lawyer is fighting for the poor victim then he will pellet the judge with emotional statements & painful words that describe his client, he will tell the judge that he is the lone bread earner of his family, has old parents to take of, & has 4 little kids , he has vowed to bring tears in the eyes of the judge, he has to prove that the man in the driving seat is a criminal of law as well as a criminal of humanity, he was so god forsaken that he didn’t even bother to stop & take the guy to hospital , that means he had something to hide, he broke the law, it was a case of irrational driving , he was drunk, he was insane , he was behaving like a ruthless king.

So it certainly is an art to bend the facts according to your desire a hit & run lawyer is truly put to the test by taking up such a case, it’s a sort of litmus test , but it also depends upon the type of damages occurred & convictions levied , is the victim dead? Is he injured? Has the accused been arrested? Has he escaped? If the victim is injured then there is quite a lot of chance that the accused will be acquitted by whatever minor punishment the court gives him if his dead then it’s a long way down , its either severe punishment a sentence & fine mostly or if the victims family agrees then a handsome compensation or blood money.
Whatever the case these lawyers are Rambos in their field ready to take on any onslaught but never giving up on whoever has paid him or her a lofty amount to save him or her so they can again enjoy to ride their cars on the highway, on the roads, on the streets, because they know that there is always a chance of survival and they are never doomed & have a chance even if they hit & run after sorting out services of a hit and run lawyer.

Hit And Run Accident Lawyers

In today’s post we will look into some of the Hit and Run cases of significance, reported by hit and run lawyers. We will see how hit and run law is dealing with suspected drivers, how the trend is increasing and the rising irresponsible behavior in our society.

Boy got Hit and run by a Driver:

Injury lawyers from Los Angeles have reported an accident of a young boy got hit by a driver of a truck and ran away from the scene of the accident. It occurred in the locality of Florence Avenue, adjacent to Figueroa Street on Monday morning around 9am.

According to the brother of the injured boy, the driver who was in his late 20’s, got out of his vehicle tried to pretend that he is making a phone call from his cell phone, got back into the vehicle and fled the scene of the accident without leaving any information. The injured kid sustained a broken leg and other minor injuries. Although the fleeing driver had been noticed by the people there and his license number has been noted, the guy has been noted as a black male.

This behavior is not at all favoring the driver, if he was thinking that he can get away with it, he is totally wrong. The cops are going to nab him sooner rather than later, so why hit and then run. The only thing good in situation like these is to show some responsibility and help the victim of your accident. Let’s take another incident:

A Hit and Run Car Driver struck Students:

LA hit and run lawyers have reported and sad accident of two USC students hit by a Black Honda Accord car in which one sustained injuries and the other was fatally injured. Los Angeles police department’s Jimmy Render stated that a back car ran a red light and struck the students when they were walking on the designated crosswalk of the intersection of Jefferson Boulevard and Hoover Street.

The 19 years old Adrianna Bachan, a resident of Santa Barbara had sustained fatal injuries from the accident, was taken to the hospital where she succumbed to her injuries and died.
The other student was thrown on the hood of the vehicle had some serious injuries, named Marcus. Was a resident of Scottsdale Arizona. He was carried to the hospital in stable condition, suffered broken legs and an arm.

Now that was insanely stupid of the driver of that Honda accord or corolla because making an accident which includes a fatality and running is just like signing a prison contract for a good period of time. These drivers just have to think that someone can hit them or their loved ones and flee the way they had done.
Now see in this incident how a hit and run driver couldn’t get away with his crime and got arrested.



Hit and Run Driver Arrested:

According to reports by personal injury lawyers in LA, a suspected driver of Hit and Run has been arrested who flee the scene after hitting a mother, her infant and a five year old.
The driver of a 1991 Honda, made a hit and run at around 1130 pm in the locality of Westlake on Sunday. The infant in the accident was fatally injured and the mother and the 5 years old had some serious injuries. The driver of the car was arrested by the Los Angeles Central Traffic division police detectives just few hours later. The arrested man was identified as Henry Moreno 30, resident of South gate LA. The police say that he driver was driving under the influence when the incident happened. The mother was pushing a stroller at Bonnie Bare Avenue at Olympic Boulevard when the accident happened. The driver Henry abandoned his car at Staples Center and fled.

The moral of the incident is that one cannot get away with the wrong doing of a hit and run. When one does that even an experienced hit and run lawyer cannot save them as it is always suspected after a runaway driver that they were driving under the influence.

Hit and Run Law and Lawyer

This post is actually first of the series of 9things which are required to be done by you when unfortunately find yourself into a vehicle accident and requires a vehicle accident lawyer.
Before you get the time to get to an attorney for legal advise, there are things which you must know in order to get the best out of the not very good situation, for that you should know some basic hit and run law. After the accident you are required to stop your vehicle and observe certain things which if you not can harm you in getting the proper compensation of your claim. If you do not stop and think that it is a minor touching and decide to move on without stopping your car, there can be chances that you get charged with hit and run and that is a crime, leaving the scene of the accident. So, if you think the accident is minor, does not matter stop as close to the scene of the accident as possible, of course without disturbing the flow of traffic. Why stopping is so important as you may be in some hurry to reach at some place ad do not want to waste your time in something you think is so minor. Hit and run has been made a bigger problem since the term has been used so much. Who are the drivers who hit and run?



In the eyes of law, the ones who run from the scene of the accident are ones who have something to hide, those who are under some drug or alcohol influence, impaired by it, DUI (driving under the influence) or DWI (driving while influenced) is a crime in itself whether you make an accident or not. The worst a drunken person can do is drunken drive and make an accident.
The runaway drivers also include ones who are not in possession of a valid or no license at all. Their license was either suspended due to some earlier violations or simply they never bothered to get one.

The list of runaway drivers also includes those who were driving without the insurance and since they have made an accident and are not able to pay the damages all by themselves. Although it is a law in every state that vehicles on the road all must have liability insurance, but still there are so many vehicles out there on the roads that run without it. If you can afford a little extra, get the uninsured drivers coverage added in your plan, you will be so much benefitted with this little investment.

Then there is another kind of drivers who just do not want to stop as they have been committing a crime while they got into a car hit and run, most of the times the car they stole get into an accident due to the rush they were in. there could be many other reasons for the hit and run accidents including simple irresponsibility.

Action by you when you see a Hit and Run:
As a good citizen, you need to report any hit and run incident to police with the vehicle number of that car who made the crime. You can be a little detective and make a picture of the car who made the hit, only if you can do it safely (you need to make a focus of the license plate of that car).

Hit and Run Penalties:
The circumstances of a hit and run are the resulting factor for penalties; it also depends on the state you are in, because felony for hit and run vary from state to state. Penalties will be higher if you leave the scene of accident and there was an injured person in that accident if there wasn’t and you only damaged the property, obviously you are going to be charged with less repercussions.

In all states of the United States it will be considered felony if you have been in a vehicle accident and you left the scene which resulted in a death or fatality, except for 3. You may ask what the heck felony is and why it is not a felony in 3 of the states. Let me tell you what is felony: Felony is a categorization of crimes and that includes but not limited to: aggravated assault and/or battery, arson, burglary, illegal drug abuse/sales, embezzlement, grand theft, tax evasion, treason, espionage, racketeering, robbery, murder, rape, kidnapping and fraud. These types of crimes can be violent or otherwise but in case of a hit and run incident it will be taken a felony of serious type because you could have saved that injured person’s life by staying at the scene and calling for help.

Why it is not a felony in the sates of Montana, Kentucky and Utah? Ask them.

Damaging unattended property:
When the owner of the property i.e. a car or any other vehicle, even a mailbox, is not there and you accidentally damaged it, it will be your responsibility to find its owner and negotiate with them. You need to wait for the owner to return as if the car was parked in front of some building there is a good chance that the owner has gone into that building. Call and inform the police if the owner cannot be located. The police will not come if the damage was little, in big metropolis police has more important work to do so they don’t come until there is an injury or a serious damage. You can wait a little for the police and if they do not turn up you can leave note for the owner of the vehicle indicating your name and telephone number. The rest of the things can be discussed on phone i.e. your insurance company and policy number etc. in addition to all this you may want to report this incident to you insurance company too.



If you are hit and run Victim:
The same scenario can happen with you for example you parked your car at some place may be just side of the road or a public parking lot and upon your return you find a big dent on your car side, now that is something which will cost a lot in repairs. You do not know who made this damage to your car so whom to held responsible for damages… does that mean you have to pay for somebody’s mistake? Let’s see what you can do to counter this. You can have UMPD which is uninsured motorists’ property damage insurance. You might want to check if you have a deductible on your coverage some states do have that and that means that the first part of the insurance covering will be paid from your pocket, which is not what you want in the scenario we discussed, so better check for the deductible clause for your UMPD. Okay so let’s assume that you have the deductible clause now what? You may want to report the matter to police so they can check from their surveillance cameras for the hit and run video.
